Co., Ltd. ("SCREEN") for trial use to review our software product. You shall not re-install This Software if you install once and uninstall it. If you want to use This Software over 30 days, please contact us. Please read carefully this LeafThrough End User License Agreement (for Trial version) ("This Agreement") provided by Dainippon Screen Mfg. Co., Ltd. The downloading, installation, use or duplication of This Software shall be deemed that you agree to be bound by each provision of This Agreement. Section 1 Construction of This Software This Software consists of the items following: Visual Search Software "LeafThrough Standalone Version" Operation Manual (pdf) LeafThrough End User License Agreement (for Trial version) (txt) "Read me first" (txt) This Software includes the following item provided to SCREEN by Global Graphics Software Limited ("GGS"): "JAWS PDF EDITOR SDK": The software that constitutes This Software and provided to SCREEN by GGS Section 2 Intellectual Properties All of copyright, patent, trademark, know-how and any other intellectual property relating This Software shall belong to SCREEN (including the licenser that grants license to SCREEN) and such intellectual property shall be preserved by Copyright Law and any other law, statute and treaty. This Software and its structure, compilation and code shall include SCREENÅfs trade secret. The license to the End User shall not be construed the assignment of copyright, patent, trademark, know-how and any other intellectual property and any kind of rights relating to This Software. SCREEN may revise, alter, improve or change This Software at any time. Section 3 License SCREEN provides the End User with the following non-transferable and non-exclusive rights: (i) The right to install and run This Software (ii) The right to make copies, pursuant to Section 4 Section 4 Restricted use and banned action The End User shall not perform and let other person(s) do any of the actions following: (i) To alter, modify, change This Software (ii) To do reverse engineer, disassemble, decompile or analyze This Software by any other possible method (iii) To delete, make unreadable or alter of the indication of patent, copy right or any other right relating to This Software and/or the Attachment documents (iv) To do anything other than permitted in express herein Section 5 Warranty "SCREEN" MAKES NO WARRANTY, EXPRESS OR IMPLIED. "SCREEN" MAKES NO WARRANTY FOR ANY PERFORMANCE OR RESULT CAUSED BY USING THIS SOFTWARE, FITNESS FOR A PARTICULAR PURPOSE OR INVASION OR A THIRD PARTYÅfS RIGHT. "SCREEN" SHALL NOT BE LIABLE FOR DEFECT RERATING TO THIS SOFTWARE. NONE OF THE PROVIDED INFORMATION AND/OR ADVICE (ORALLY OR IN WRITTEN FORM) BY THE EMPLOYEE OF "SCREEN", DEALER, RESELLER OR DISTRIBUTORS SHALL RAISE THE WARRANTY OF THIS SOFTWARE, NOR THE END USER MAY REQUEST ANY WARRANTY FROM "SCREEN" BASED ON SUCH INFORMATION AND/OR ADVICE. Section 6 Limitation of liability 1. "SCREEN" SHALL NOT BE LIABLE TO THE END USER FOR ANY DAMAGE (SUCH AS LOSS OF PROFIT, DAMAGES CAUSED BY THE CESSAION OF PERFORMANCE, LOSS OF DATA OR INVASION OF A THIRD PARTYÅfS RIGHT, ANY SPECIAL DAMAGES, CONSEQUENTIAL DAMAGES, INDIRECT DAMAGES, INCIDENTAL DAMAGES OR ANY OTHER DAMAGES BUT NOT LIMITED TO MONETARY DAMAGES), EVEN IF SCREEN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, THE SUM OF MONEY "SCREEN" COULD BE EXPECTED TO PAY TO THE END USER WITH RESPECT TO THIS SOFTWARE SHALL BE LESS THAN THE SUM THE END USER HAS PAID FOR THIS SOFTWARE. 2. "SCREEN" SHALL NOT BE RESPONSBILE FOR CORRESPONDING TO THE INQUIRY OF THE END USER ABOUT THE USAGE OF THIS SOFTWARE OR FUNCTIONS OR TO THE NOTICE ABOUT THE PROBLEMS AND PHENOMENA CAUSED BY THIS SOFTWARE. EVEN IF SCREEN CORRESPONDS TO SUCH INQUIRY OR NOTICE, THE LIMITATION OF LIABILITY FOREGOING SHALL APPLY. Section 7 Minor Version Upgrade SCREEN can provide the End User with minor version-upgrade ("Minor Version-Upgrade") of This Software. The terms and conditions herein shall apply to the Minor Version-Upgrade. SCREEN can provide the End User with such Minor Version-Upgrade and decide its contents such as the timing, frequency and details of Minor Version-Upgrade at its sole discretion. Section 8 Termination of rights The End User shall lose the right to use This Software if the End User breaches any of the terms and conditions of This Agreement. The End User shall stop using This Software immediately and delete This Software, as well as its copy, if this Agreement is terminated. The End User shall not have any right or authority anymore once This Agreement is terminated. Section 9 General conditions 1. The terms and conditions of This Agreement shall supersede all of arrangements that the End User and SCREEN has agreed before the conclusion of This Agreement with respect to license of This Software. SCREEN can change the contents of This Agreement without any prior notice to the End User. If such change is provided, the previous contents of This Agreement shall become inure and void and the latest contents shall be applied. 2. If This Software is acquired under the terms of a proposal or agreement with the United States Government or any contractor therefor, the Software is subject to the following restricted rights notice: "This Software is commercial computer software provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in subparagraph (c) (1) (ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013, FAR 52.227-17 Alternate III (g) (3), or subparagraphs (c) (1) and (2) of the Commercial Computer Software ? Restricted Rights at 48 CFR 52.227-19, as applicable, and their successor provisions. Contractor/Manufacturer is Dainippon Screen Mfg. Co., Ltd., Teranouchi-agaru 4, Horikawa-dori, Kamigyo-ku, Kyoto, Japan" 3. The End User agrees that This Software shall be the subject to the applicable export laws and regulations of each country. The End User shall comply with any and all international and domestic laws and regulations (including the restrictions on the end user, end use and destinations) that is applicable to This Software. 4. This Agreement shall be governed in law of Japan. The End User agrees that any conflict respect to This Agreement shall be subject to the exclusive jurisdiction of the Kyoto District Court.
